Terms of Service

These terms cover your use of festival things, the website at festival-things.com (the "service"). By creating an account or using the service, you agree to these terms.

Who we are

The service is operated by Michael Bonner. You can reach us at [email protected].

Beta service

festival things is currently in beta. Features may change, break, or be removed without notice. We may impose reasonable usage limits or take features offline for maintenance. The service is provided free of charge during beta; if that changes, we'll give you notice before charging anything.

Eligibility

You must be at least 13 years old to use the service. If you're under the age of majority in your country, you confirm that you have permission from a parent or guardian. You may not use the service if you've previously been suspended or banned.

Your account

  • Give us accurate information when you sign up and keep it up to date.
  • Keep your password safe — you're responsible for activity that happens under your account.
  • Tell us promptly if you think your account has been compromised.
  • One person per account. You can be a member of multiple groups under the same account.

Your content

You keep ownership of the things you add to the service — your wishlist picks, group names and descriptions, avatar images, and any other content you upload. You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content for the purpose of operating festival things — for example, to show your picks to the other members of your group, or to display your avatar in the app.

You're responsible for what you upload. Don't upload anything you don't have the right to share, and don't upload anything that breaks our Acceptable Use Policy.

Festival, artist, and Spotify data

Festival lineups, artist names, images, genres, and links to external services like Spotify or Apple Music are provided for informational purposes. They are sourced from public APIs and third-party data and may be incomplete or out of date. Set times shown in the app are subject to change by the festival organizers — always check the festival's official schedule before you plan your day.

Acceptable use

Your use of the service is also governed by our Acceptable Use Policy, which is part of these terms.

Group invitations

When you invite someone to a group, you're confirming that you have a reasonable basis to believe they'd want to receive that invitation. Don't enter email addresses of people you don't know personally, and don't use the invite feature to send unwanted email.

Suspension and termination

You can delete your account at any time. We can suspend or terminate your account if you break these terms, abuse the service, or expose us or other users to legal risk. We may also discontinue the service entirely, in which case we'll try to give reasonable notice.

Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the service will be uninterrupted, secure, or error-free, or that the festival and set-time information shown in the app is accurate or complete.

Limitation of liability

To the maximum extent permitted by law, festival things and Michael Bonner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use, arising out of or in connection with your use of the service. Our total liability for any claim relating to the service is limited to the greater of (a) the amount you've paid us in the twelve months before the claim arose (which, during beta, is $0), or (b) one hundred US dollars.

Indemnification

You agree to indemnify and hold festival things harmless from any claims arising out of your content, your use of the service, or your violation of these terms.

Governing law

These terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Utah, and you consent to the jurisdiction of those courts.

Changes to these terms

We may update these terms from time to time. If the changes are material, we'll update the date at the top and, where appropriate, notify you by email or in the app. Continuing to use the service after a change takes effect means you accept the new terms.
